Abstract:

Requests the Louisiana Board of Ethics to issue an advisory opinion clarifying whether the employees of a private charter school operator who work at a public charter school operated by their employer are “public employees” as defined in the Louisiana Code of Governmental Ethics.

Position: Oppose With Caveats

First of all, Sen. Murray’s contention in this resolution that, “it has become prevalent in Louisiana that public charter schools, of varying types, are operated by for-profit private educational management companies, under contract with the not-for-profit company that was the recipient of the charter,” is misleading. The number of charter schools which are managed by a for-profit operator on behalf of a non-profit board are a small minority and certainly isn’t the case in Sen. Murray’s hometown of New Orleans. (On the other hand, I wish the Legislature would ban the for-profit management arrangement outright, because it only hurts public perceptions of charter schools and hasn’t proven to be a successful model.)

Second, it should already be very clear that charter school employees are public employees. (As I alluded to before, it would be a mistake to contend that they are anything other than public employees, since that could make charter schools subject to private-sector labor laws and oversight.) If there are any for-profit education management organizations informing their employees that they are not public employees, as Sen. Murray contends, those isolated cases should be addressed by charter oversight officials at LDOE. There is no need to get the Louisiana Board of Ethics involved to address this issue.
